OFFICIAL RULES
1. Eligibility
1.1. The "Color Bar Makeover" Giveaway Contest (the "Contest") is open to legal residents of North America who are 18 years of age or older at the time of entry (“Eligible Entrant”). You are not eligible if, during the entry period you are an employee, officer, director, agent, or representative of Vish (the "Sponsor"), its parent companies, affiliates, subsidiaries, and advertising and promotional agencies, as well as immediate family members and household members of each, are not eligible to participate in the Contest. Eligible Entrants must be salon owners within Canada and the Continental United States. If the salon space is leased, entrants must have written permission from their landlord to complete the renovation. The Selected Entrant will win the Prize as defined herein.
2. Contest Summary
2.1. The Contest begins on July 22nd, 2024, and ends on September 9, 2024, at 5:00 pm EST (the "Contest Period"). All entries must be received during the Contest Period to be eligible. There is up to one (1) Prize available to be won in this contest, as described in Paragraph 5 (the “Prize”).
3. How to Enter
3.1. No purchase is necessary to enter this Contest. To enter, Eligible Entrants must complete the entry form available at https://getvish.com/color-bar-makeover during the Contest Period. Each entry must include all requested information, including but not limited to the Entrants name, salon name, location, contact information, and a brief description of why the salon should receive the makeover. Limit one (1) entry per Entrant. Multiple entries from the same person will be disqualified.
Once submitted, Entries become the sole property of Vish Limited and will not be returned.
4. Selection of Winner
4.1. One (1) winner will be selected by Vish based on the merit of the entry. The winner must respond within seven (7) days of notification to claim the Prize. The response from the Winner can be via an email reply to the address by which they were informed of their prize, info@getvish.com, or at 1-888-419-6391.
If necessary, should a Prize be unclaimed, or should the Selected Entrant be unwilling, unable, or ineligible to win a Prize as set out in these Official Rules, the Prize will be forfeited and Vish Limited shall have the right to select, as replacements only, additional Entries.
The Selected Entrant will not be declared a winner until:
Vish Limited has determined the Selected Entrant is an Eligible Entrant pursuant to these Official Rules;
The Selected Entrant correctly answers, without assistance of any kind, whether mechanical, electronic, or otherwise, a skill testing question as set out in these Official Rules; and
The Selected Entrant executes a release and waiver.
The Selected Entrant has provided measurements, photos and/or videos of the space that will be renovated to Vish.
The Selected Entrant has met with a Vish representative via Zoom or phone call to discuss the next steps, eligibility and confirm all details provided in the entry.
The Selected Entrant agrees to use the Vish app and scale(s) in their Salon for a period of at least six (6) months (costs included in Prize).
The Selected Entrant agrees to allow representatives from Vish attend and film installation and Vish onboarding/education.
5. Prize
5.1. There will be one (1) Prize available to be won. The chances of winning the Prize will depend on the number of Eligible Entrants received in accordance with these rules during the Contest Period. One (1) winner will receive a salon color bar renovation valued at up to $28,000 USD.
Please note that the images shown in the marketing materials are for illustrative purposes only and do not precisely represent the actual prize.
The Prize is non-transferable and no cash alternative will be offered. If the winner is renting or leasing the salon space, they must provide written permission from their landlord to complete the renovation prior to prize fulfillment. The actual value of the renovation will be determined by the specific needs and conditions of the winner's salon and may not exceed $28,000 USD. Any other tax or other expenses not explicitly specified as part of the Prize are the Winner’s sole responsibility. Vish Limited is not responsible for factors beyond its control to prevent the Prize from being fulfilled. The Prize will only be granted to the verified Winner. All product, furnishings and construction materials will be used exclusively for professional salon services inside the salon located at the registered business address of the prize winner.
Prize may not be resold for a period of (12) months after delivery.
The total “Prize” is broken down as follows:
“Furnishings” from Minerva Beauty, Inc: shipped retail value up to $10,789 USD.*
“The Gift of Vish” includes Vish Bluetooth scales (varies based on size of salon), tech setup, onsite education, one (1) iPad per scale, one (1) iPad stand per scale, one (1) mixing mat per scale, and six (6) months of Vish subscription costs: retail value up to $5,493 USD.**
“Business Coaching” includes 6 hours of coaching services via Zoom provided by a Vish representative: retail value of $900 USD.
“Color Bar Restock” includes professional hair color purchased: retail value up to $5,000 USD.***
“Installation Allowance”: Vish will reimburse the Winner up to $6,000 USD to cover costs associated with the installation of the “Furnishings” that are incurred by the Winner.
*****The selected entrant will be required to meet with representatives from Vish and Minerva Beauty, Inc to select materials and finishes from a specific list of options for the “Furnishings” that will be installed. No substitutions outside of the provided options are allowed. All Furnishings will be delivered to the company address provided and will need to be moved inside the building and installed by the Winner and/or their hired contractors. Delivery and installation of the furnishings must be scheduled by the Winner.
**If the Winner is already a Vish customer or purchases a Vish subscription package between entering and the contest close date, the value of “The Gift of Vish” will be applied to their account in credits towards their monthly subscription costs.
***The “Color Bar Restock” will be provided to the Prize Winner via the official manufacturer/distribution company of one of their product lines at the sole discretion of Vish. The product awarded is not for resale and must be used for professional services inside of the salon.
****Receipts for the “Installation Allowance” must be submitted to Vish within thirty (30) days of the charge and are subject to review by Vish representatives. Vish will reimburse the Winner for approved expenses (up to $6,000 USD) electronically within 30 days of receiving the receipts.
Installation Deadline: The winner must arrange for the installation of the color bar makeover to be completed by March 31st, 2025. It is the sole responsibility of the winner to coordinate and schedule any necessary contractors or services required for the installation. Vish shall not be held liable for any delays, scheduling conflicts, or failure to meet the installation deadline due to the winner's actions or inactions. Failure to complete the installation by the specified date will result in forfeiture of the prize without any obligation or liability to the promoter.
6. General Conditions
6.1. By participating in the Contest, participants agree to be bound by these Terms and Conditions and the decisions of Vish, which are final and binding in all respects. Vish reserves the right to cancel, suspend, and/or modify the Contest, or any part of it, if any fraud, technical failures, or any other factor beyond Vish's reasonable control impairs the integrity or proper functioning of the Contest, as determined by Vish in its sole discretion. Vish reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Terms and Conditions or in an unsportsmanlike or disruptive manner.
Participation in this Contest constitutes an agreement by each participant to comply with these Official Rules.
Vish Limited reserves the right, in its sole discretion, to disqualify an Entrant if it finds to tamper or attempt to tamper with the entry process or the operation of the Contest, if the Entrant is in violation of these Official Rules or if the Entrant is violating the terms of service, conditions, use and/or general rules or guidelines for this Contest. If an Entrant is disqualified for any reason, another entry will be selected from the remaining Eligible Entries received as set out in these Official Rules.
7. Release and Indemnification
7.1. By entering this Contest, each Entrant: (a) release and holds harmless Vish Limited and its directors, officers, employees, parent companies, subsidiaries, affiliates, suppliers, sponsors and agents from any and all liability for injuries, loss or damage of any kind to persons, including death, property damage, or lost revenue, resulting in whole or part, directly or indirectly, from acceptance, possession, use or misuse of any Prize, participation in the Contest of participation in the Entry; and (b) agrees to fully indemnify the Sponsor and its directors, officers, employees, parent companies, subsidiaries, affiliates, suppliers and agents from any and all claims on the part of any third party or parties related in any way and for any reason to the Contest or to the Prize, including, without limitation, death or personal or property damage or injury.
Vish is not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors, or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest or receipt or use or misuse of any prize.
8. Privacy
8.1. Any personal information collected during the course of the Contest will be used in accordance with Vish's Privacy Policy and as set out in these Terms and Conditions.
9. Governing Law
9.1. The Contest and these Terms and Conditions shall be governed by and construed in accordance with the laws of Newfoundland and Labrador, without regard to its conflict of law provisions.

Vish Color Bar Makeover Campaign Voting Rules and Regulations
1. Eligibility: Voting is open to individuals who are 18 years of age or older at the time of participation. Each participant is required to provide a valid email address to cast a vote. Employees, representatives, and agents of Vish, as well as immediate family members (spouse, parent, child, sibling, and their respective spouses) or individuals residing in the same household, are not eligible to vote.
2. Voting Period: The voting period begins immediately upon the announcement of the Top 3 Finalists and will end on October 20th, 2024, at 11:59 PM Eastern Time (ET). Votes submitted after the close of the voting period will not be counted.
3. Voting Limitations: Each eligible participant may cast one vote per email address per day. Attempts to vote using multiple email addresses, automated systems, bots, or any other unauthorized methods are strictly prohibited and may result in the disqualification of those votes. Spam emails will not be considered and may result in the exclusion of associated votes.
4. Vote Counting: Vish reserves the right to review and validate votes to ensure compliance with these rules. Any suspected instances of fraud, tampering, or voting manipulation may result in the disqualification of votes at Vish’s sole discretion.
5. Final Determination of the Winner: Vish will make the final determination of the winner and reserves the right to verify the eligibility of all votes and participants. The winner will be announced on or after October 21st, 2024.
6. General Conditions: By participating in the voting process, participants agree to comply with these rules and to Vish’s decisions, which are final and binding in all respects. Vish reserves the right to modify, suspend, or terminate the contest or voting process at any time, with or without notice, for any reason, including but not limited to fraud, technical issues, or any other causes beyond Vish’s control.
7. Privacy: The personal information provided during the voting process will only be used to administer the contest and will not be shared with third parties except as necessary for vote verification or as required by law.
